Purpose of the ordinance:
Governor Punjab Chaudhry Mohammad Sarwar issued an ordinance to regularize private housing schemes with the title, “The Punjab Commission for Regularization of Irregular Housing Schemes Ordinance 2021” to boost customer confidence. It seems to be an active step to initiate actions against irregular housing schemes across the Punjab province. The commission aims to vet violations. The authorities gave a notion through this ordinance that illegal housing schemes will not be tolerated anymore in the province and strict legal action will be taken against all irregular housing societies.
What is an irregular housing scheme?
Irregular housing scheme means a private housing scheme or a land sub-division or a built-up area which has been developed or a part of which is being developed or sold without approval of the competent authority or in violation of the approved layout plan or the applicable laws or with the approval of the authority not competent to approve the housing scheme. There are numerous schemes that comes under this category across Punjab, it is significant and need of the day to vet and regularize them to gain more customer confidence towards real estate sector.
Formation of an active and experienced commission:
According to the Regularization of Irregular Housing Schemes Ordinance 2021 a vigorous, experienced and authorized commission will be established. The commission will comprise the following:
- Chairperson: A retired judge of the supreme court of Pakistan or of a high court
- A town planner having at least twenty years of experience
- A civil engineer having at least twenty years of experience and accreditation from national or international professional bodies
- An environment expert having at least twenty years of experience
- A legal expert having at least twenty years of experience in the applicable laws
- Any other expert of the relevant profession from public or private sector (Co-opted by the commission)
This empowered and experienced commission will play a pivotal role in regularization of irregular housing schemes in Punjab and it will speed up the regularization process. This commission will possess the powers to impose fines, recommend disciplinary actions against the officers and officials responsible for establishment of irregular housing schemes, regularize any non-conforming land use and recommend amendments in the applicable rules and laws.
Role of local government and development authorities.
A local government or a development authority shall be responsible to provide the secretarial support to the commission, prepare and submit data bank of irregular housing schemes. This support will facilitate the commission to mark its own authority over housing schemes.
Fines to the irregular housing societies:
The irregular housing societies will be fined in the following cases:
- Non-conforming land use
- Missing parks, open spaces or public buildings
- Missing graveyard
- Access road width is less than the required planning standard
- Internal road width is less than the prescribed standards
The government says illegal schemes not to be tolerated and it is happening for the betterment of the real estate sector. The good news is that government has more intention towards regularization instead of banning the irregular housing schemes. It will definitely boost customer confidence.
